Information on Data Processing for Resumes

 

The Company MONTEMURRO UTENSILI SRL based in Prata Camportaccio (So) as Data Controller of personal data in accordance with art. 4 of the EU Regulation 2016/679 informs you, pursuant to art. 13 of the Regulation, that it will process your personal data manually and/or with the support of computer means exclusively to evaluate your application for the purpose of a possible future establishment of an employment relationship with the Company.

 

Purpose of processing

The personal data you provide, either spontaneously or as a result of a selection process, by sending your CV will be processed for purposes connected with or instrumental to the performance of the activity of searching for and selecting candidates, or to propose any other job offers relevant to your professional profile.

We would like to inform you that the provision of personal data is optional, but your refusal to provide them would preclude us from evaluating your application.

 

Legal basis of processing

The processing is necessary within the meaning of Article 6(1)(b) of the Regulation for the performance of pre-contractual measures taken at your request.

 

Data recipients

The data may be disclosed to employees and collaborators of the Data Controller who may process your data in accordance with the instructions given by the Data Controller.

Your personal data may be processed by third parties who collaborate with the Data Controller for the same purposes. These subjects may, depending on the case, operate as autonomous data controllers or as specially appointed data processors.

 

Data transfer

The Data Controller does not transfer personal data to third countries or international organisations.

However, it reserves the possibility of using cloud services; in which case, the service providers will be selected from among those who provide adequate guarantees, as provided for in Article 46 GDPR 679/16.

 

Data retention

Your personal data will be processed for the time necessary to fulfil the purposes indicated.

The data will be kept for a maximum period of twelve months from the date of sending the curriculum or from the date of the last update of the curriculum communicated by the person concerned.

 

Rights of the data subject

Pursuant to Articles 13(2) and 15 to 21 of the Regulation, we inform you that you may exercise the following rights with regard to the processing of your personal data:

 

  1. (a) Right to obtain access to personal data and to the following information:

- confirmation as to whether or not your personal data are being processed;

- the purposes of the processing;

 

categories of personal data;

- the recipients or categories of recipients to whom the personal data have been or will be communicated;

- where the data are not collected from the data subject, all available information on their origin;

- the existence of an automated decision-making process, including profiling;

- a copy of the personal data being processed.

 

  1. b) Right of rectification and integration of personal data;

 

  1. c) Right to erasureof the data ("right to be forgotten") if one of the following reasons applies:
  2. personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  3. the data subject withdraws consent to the processing of the data and there is no other legal basis for the processing;
  4. the data subject objects to the processing and there is no overriding legitimate reason for processing;
  5. personal data have been unlawfully processed;
  6. personal data must be erased in order to comply with a legal obligation laid down by Union or Member State law to which the controller is subject.

If a data controller has made personal data public and is obliged to erase them, it must inform the other data controllers of the request to erase any link, copy or reproduction of its data.

 

  1. (d) Right to restriction of processing in the event that:
  2. the data subject contests the accuracy of the personal data, for the period necessary for the controller to verify the accuracy of such personal data;
  3. the processing is unlawful and the data subject objects to the deletion of the personal data and requests instead that their use be restricted;
  4. although the data controller no longer needs them for processing purposes, the personal data are required by the data subject for the establishment, exercise or defence of legal claims;
  5. the data subject has objected to the processing, pending verification of whether the legitimate reasons of the data controller prevail over those of the data subject.

 

  1. e) Right to lodge a complaint to the Garante for the protection of personal data, following the procedures and indications published on the official website of the Authority garanteprivacy.it.

 

  1. f) Right to data portability The data subject shall have the right to receive in a structured, commonly used and machine-readable format personal data concerning him or her that have been provided to a data controller and, where appropriate, to have them transmitted to another data controller, where the processing is based on consent or on a contract and is carried out by automated means. Where technically possible, the data subject shall have the right to obtain direct transmission of the data from one controller to another.

 

  1. g) Right to object at any time to the processing of personal data, including profiling, in particular if:
  2. processing is carried out on the basis of the legitimate interest of the data controller, subject to an explanation of the reasons for the objection;
  3. personal data are processed for direct marketing purposes.

 

  1. h) The right not to be subject to a decision based solely on automated processing, including profiling, except where the decision: is necessary for the conclusion or performance of a contract between the data subject and a data controller, is authorised by Union law or by the law of the Member State to which the data controller is subject, or is based on the explicit consent of the data subject.

 

  1. (i) Right to withdraw consent at any time; if the data does not have any other legal basis (e.g. fulfilment of a legal obligation or performance of a contract), it must be deleted by the data controller.

 

The exercise of rights is not subject to any formal constraints and is free of charge.

This information is provided pursuant to art. 13 of EU Regulation 679/2016 by the Company MONTEMURRO UTENSILI SRL with headquarters in Prata Camportaccio (So) as Data Controller to those who access the website of the Company Montemurro Utensili srl itself and fill in the "contact" form authorizing the same Company to process their personal data.

The provision of data is optional. Refusal to provide data will make it impossible to process and follow up on requests received.
